Welcome to Potly.Win ("Platform", "we", "us", "our"), operated by [PotlyWin LLC]. By accessing or using Potly.Win, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

1. Eligibility

You must be at least 13 years of age to create an account and use the Platform. Users under 18 may play games but are not eligible to receive cash prizes. To receive prize payouts, you must be at least 18 years old (or the age of majority in your jurisdiction) and able to legally receive payments.

The Platform is available internationally. However, it is your responsibility to ensure that participating in skill-based contests with prizes is legal in your jurisdiction. We reserve the right to restrict access from any region at our discretion.

This contest is void where prohibited by law. It is the user’s responsibility to comply with local prize-winning regulations. If your local law prohibits receiving cash prizes for free-to-play skill games, you are ineligible to participate in the prize pool.

2. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. Each person may maintain only one account. Creating multiple accounts to manipulate leaderboards or prize eligibility will result in permanent bans and forfeiture of any prizes.

3. No Purchase Necessary

Potly.Win is 100% free to play. There are no entry fees, in-app purchases, or any form of payment required to participate in games or compete for prizes. Prize pools are funded entirely through advertising revenue. Winning is based purely on the player’s manual dexterity, reaction time, and strategy. No element of chance, such as random number generation or luck-based mechanics, determines the outcome of the leaderboard.

4. Prize Structure

• Each game has its own monthly prize pool funded by advertising revenue generated from gameplay.
• Ad revenue is defined as the 'net' revenue received by the Platform from its third-party ad providers (e.g., Google AdSense) after any deductions for invalid traffic or clawbacks by the provider. The Platform’s internal dashboard serves as the final authority on monthly revenue figures.
• 80% of each game's monthly ad revenue is allocated to the prize pool, split among the top 3 players: 1st Place (50%), 2nd Place (30%), 3rd Place (20%).
• 20% is retained by the Platform for operations, hosting, and payment processing.
• Prize pools reset on the 1st of each month.
• Prize amounts are not guaranteed and vary based on actual advertising revenue each month.
• In the event of a tie, the player who achieved the score first (by timestamp) ranks higher.
• All contests on the Platform are Games of Skill. Winning is determined solely by the player's physical coordination, reaction time, and mental strategy. The odds of winning are not affected by chance, and the Platform does not use random number generators (RNG) to determine leaderboard standings.
• The odds of winning any prize depend entirely on the number of participants and the relative skill level of the players. Because the prize pool is funded by actual ad revenue, the final prize amounts are 'estimated' until the close of the monthly period.

5. Prize Payouts

• Winners are determined at the end of each calendar month based on final leaderboard standings.
• Payouts are processed via PayPal within 15 business days after the month ends.
• Winners must have a valid PayPal account to receive prizes.
• Minimum payout threshold is $5.00 USD. Prizes below this amount roll over to the next month.
• For US-based winners, prizes exceeding $600 in a calendar year require a W-9 form for tax reporting purposes.
• You are solely responsible for any taxes owed on prize winnings in your jurisdiction.

6. Fair Play & Anti-Cheat

We take fair play seriously. The Platform employs automated anti-cheat systems including server-side score validation, statistical anomaly detection, and behavioral analysis. By using the Platform, you agree to the following:

• You will not use bots, scripts, macros, or any automated tools to play games.
• You will not modify, reverse-engineer, or tamper with game code or network requests.
• You will not exploit bugs or glitches. If you discover one, report it to us.
• You will not collude with other players to manipulate leaderboard rankings.
• You will not use multiple accounts for any purpose.

Violations may result in score invalidation, account suspension, permanent bans, and forfeiture of any pending prizes, at our sole discretion. Flagged scores may be subject to manual review before prizes are awarded.

7. User Conduct

Usernames must not contain offensive, discriminatory, threatening, or sexually explicit content. We reserve the right to force a username change or suspend accounts with inappropriate usernames without notice.

8. Intellectual Property

All content on the Platform, including games, graphics, logos, sounds, and text, is owned by or licensed to [PotlyWin LLC] and protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any Platform content without our written permission.

By participating and ranking on a leaderboard, you grant the Platform a non-exclusive, worldwide, royalty-free license to display your username and high score for promotional and transparency purposes.

9. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Platform will be uninterrupted, error-free, or secure. We are not responsible for any loss of data, scores, or prize eligibility due to technical issues.

10. Limitation of Liability

To the maximum extent permitted by law, [PotlyWin LLC] shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the amount of any prize you were eligible to receive.

11. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Platform after changes constitutes acceptance of the revised Terms. Material changes will be communicated via email or site notification.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may delete your account at any time by contacting us. Upon termination, any pending prizes are forfeited unless the termination was initiated by us without cause.

13. Governing Law

These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in the City of Peoria, AZ, in accordance with the rules of the American Arbitration Association.

In accordance with Arizona law, participation is strictly free of charge. No purchase, payment, or other consideration—including the disclosure of sensitive personal data or completion of lengthy commercial tasks—is required to enter or win. The viewing of advertisements is a passive activity and does not constitute 'consideration' or a 'wager' under A.R.S. § 13-3301.
